The Study on Desirable Protection System for the Sensitive Outcome of Technology Development

Abstract: Sensitive technologies which can be applied to Weapons of mass destruction technology such as Uranium enrichment technology spent nuclear fuel reprocessing technology biological and chemical technology have been developing actively in private sector in Japan. There is high probability that such developed sensitive information will be applied for patent. In Japanese patent system all application shall be opened to the public throughout the world therefore it is afraid that the diffusion of those sensitive technologies through legislative disclosure process. From this point of view this article shows the desirable legislative system to be established in Japan based on the investigation on gsecret patent systemh which is introduced in most all of developed countries and existing similar legislative system in Japan. In addition this article also examines consistency between the desirable secret patent system and international/national legislative framework as well as the significance of the proposed system based on practical example.
